The foreign entrepreneur who wishes to invest in Hungary must first make sure that he has registered his trademark or patent, so that he can fully enjoy the tools recognized by the legal system for the protection of intellectual property. Hungary is party to numerous agreements on the protection of intellectual property including the Madrid Protocol; moreover, being a member of the European Union, it is a signatory to the European Patent Convention. Under Hungarian law, trademarks are protected if they are registered with the National Patent and Trademark Office or with the World Intellectual Property Organization. The protection of the registered trademark has a duration of ten years while the protection granted to patents has a duration of twenty years. Hungarian law also recognizes the patentability of production processes. Before registering your trademark, it is advisable to carry out, not only a check on the existence of another trademark already registered in the country that is identical or too similar, but also, a careful study on its transliteration into Hungarian, to avoid that a brand that is considered particularly attractive in its own language takes on a completely different meaning in Hungarian. Finally, it must be remembered that to proceed with the registration of the patent, both citizens and foreign companies must necessarily make use of an on-site representative who can also be a Hungarian lawyer.
