This type of contract is very developed in Morocco and is part of business contracts, together with agency, distribution, and commission. The contract relates a franchisee and a franchisor. The franchisor grants the franchisor the right to use and distribute its own brand and label for commercial purposes, as well as the right to produce the franchisor's products and the right to market them. As a counterpart, the franchisee undertakes to pay a sum calculated on its turnover and to submit to a list of obligations, such as, for example, complying with specific technical rules relating to the manufacture of the product, at known prices, as well as to the rules related to the preparation of the commercial space. In Morocco, the franchise agreement is not subject to specific legislation. Consequently, the parties to the contract have space for maneuver to draft the clauses according to their convenience and organize their relations according to their needs.
